Trademark offences

A trademark is a symbol, word or words legally registered or established by use as representing a company or a product. These include therefore, logos, catchphrases, slogans that are closely associated with a business. It is a criminal offence to sell or possess counterfeit goods, which infringe on the trademark of another’s, without their consent. It is a complex area of law, as the defendant does not need to have actual knowledge that the good were counterfeit.

It is often the case that these will be dealt with in civil proceedings, however, in more serious cases a prosecution will be sought. Lloyds PR Solicitors have often acted on and successfully defended such prosecutions.
