Confiscation is a process brought against a person convicted of an offence ordering him to pay back the “benefit” of that crime. Usually, the benefit is financial and can include money, property, crypto assets and luxury items. Confiscation occurs post-conviction and the provisions for it are set out in the 2002 Proceeds of Crime Act.

Confiscation orders can be difficult to challenge and this can be frustrating for individuals who have been convicted and are often facing time in custody.
